This is a true Audio & Transcript of Mark Yates, Will Beard & Wilma Wilke discussing killing me at my workplace, Blue Grass Automotive in Louisville, Kentucky. After the discussion I was assaulted three times with a caustic substance by Tyler Stone and also had bugs thrown in my hair. This crime was covered up I received no assistance from my local officials and my telephones & mail have been monitored and intercepted for years. I do not know if Mark Yates is related to Carl Yates a Sheriff in my town or David Yates, a Metro Council Member & possible previous U.S. Attorney Employee in Louisville, KY. I do Fear for my Life. (Note: After this conversation, which took place on April 26, 2004, in May 2004 I was assaulted three (3) times and also had bugs thrown in my hair by Tyler Stone at Bluegrass Automotive (fomerly located on Shelbyville Road in Louisville, Ky, and to date possibly operating under another name). I went to Jewish Hospital twice, once by ambulance. I received no assistance from the EEOC, the police, FBI, or the United States Attorney General's Office in Louisville Kentucky, and the cover-up begin)

C - Ok, I filed assault charges against Tyler Stone and it took me, I guess, a good two months or so after I filed the charges to find out who the prosecutor was, because nobody would give me any information. So I'm trying to find out how the assault charges I filed against Tyler Stone, do you need the case number,
O - Uh, yeah
C - The case number is 04-M

O - Right
C - and I'm trying to find out who changed three (3) Assault charges to Harassment with No Physical Contact, because I said nothing about a...

C - Do I need to refile my charges because I said, well, ok cause I said nothing about harassment
O - Actually, it really doesn't make any difference, uh, what charges you think they're going to have, the prosecutor is always the one that has the statutory obligation (?????) the changes (???) more appropriate (???????)
C - Ok, what bothers me about it, Mr. O'Malley is Doc O'Connor is one of the people I originally spoke with when I came down there regarding Irv Maze,
O - Right
C - I spoke with him originally. I think it's very strange that three (3) assaults, I told him, I mean I told the girl about three (3) assaults. I did not say anything about harassment because the guy did not say too much of anything to me. He threw stuff on me three (3) times and sent me to the hospital twice to the emergency room. My skin was burning, my skin was itching, all of this information was given to her when I filed my complaint, so how do three (3) assaults get changed to harassment with no physical contact, I have a problem with that so who...
O - All I know is when the case went into court (?????), into court and, uh
C - I know they set the trial for the 15th, I'm aware of that, but I'm trying to find out

C - Right, I'm trying to find out who could change three (3) assaults, I said nothing about harassment because he barely said anything to me.

O - I don't have the slightest idea of who made the recommendation on it, but what I'm telling you
C - Well, Doc O'Connor is the one that did, because I found out
O - That was his decision as far as what to do and set it for trial, if the prosecutor, if the court thought it was an inappropriate charge they could amend it to whatever, apparently they haven't done that because it's still set for trial on harassment no physical contact.
C - Right, what I'm trying to find out right now is how to get this changed to what I originally filed, I didn't say anything about anybody cursing me out

C - I know I have my court date coming up
O - You're not going to be able to come in and take out a new complaint on these people
C - Why not?
O - Because the incident is in court now
C - Well, Harassment is in court now, I said I filed Assault

O - Mam, you came in and took out a complaint. The prosecutor felt it was (????????)
C - The prosecutor is not even supposed to be handling my case. Doc O'Connor was not supposed to be handling my case.
O - Mam, Mam, you don't tell us how to do our job

O - I'm telling you the prosecutor looked at it, felt that it was Harassment
C - That was Doc O'Connor. That was Doc O'Connor
O - And he's a prosecutor and he's in the Warrant Division
C - But he is in my complant that I have against Irv. Maze, that's in Cincinnati, so why is he handling my complaint.
O - Our office won't be handling the trial.
C - But, but, I'm saying that explains how it got change to Harassment, No Physical Contact. What could have made it Harassment, No Physical Contact, when I told them stuff was thrown on me. I never said he said anything.
O - All I, All I know is I'm not for sure if he's the one that signed the warrant. But, uh,
C - Well, that's what they told me when I was down there.
O - Well I don't have a copy in front of me (?????) warrant court (?????) sheriff's office (?????)
O - All I know is the incident itself is now in court and (????) have anything more to do with it
O - It is up to the prosecutor in Warrant Court to either amend the charge of to go forward with whatever fact they have and prosecute.
C - Ok, but the thing that bothers me about it is Harassment, No Physical Contactis totally different thanAssault, Three Assaults, Not One Assault, Not Two Assaults, But Three Assaults, so how does Three Assaults get change to Harassment, No Physical Contact.
O - I've only looked at the one that, uh the Stone, Tyler Stone case
C - Well, that's all I'm looking at, too
O - Are the other ones on trial, too
C - Those are different than Tyler Stone
C - Tyler Stone assaulted me three (3) times. He assaulted me three times. I had a substance thrown on me three times that sent me to Jewish Hospital twice, so that's what was told to the person that took the...
O - No, Mam, what you need to do is talk to the prosecutor in court, and see if they can (????) now that is in warrant court. That is the only place it can be changed.
O - They can always amend it to something else, yeah
C - Who would have made it harassment, no physical contact. That sounds kind of "fishy" to me. When I did not say anything like that to them.
O - I have no idea why it was changd that way. They may have thought that was a more appropriate charge.
C - How can you think that when a person tells you they've been to the hospital, the Emergency Room, twice, how can you come up with,......
O - Do you have your medical records and everything.
C - You don't have to have your medical records when you file a report. I told her I had been to the hospital twice to the Emergency Room. When you file a complaint you don't have to bring your medical records in, was my understanding. So I told her I had been to the hospital twice to the Emergency Room. I told her I had to get shots, I told her that, I told her about my skin itching and burning. I told her about my hair falling out. I didn't say, what words did I say that says he harassed me. What in the complaint that says he harassed me, I mean, what does the original complaint say?
O - Harassment with Physical Contact (????), touching you or doing something to create a problem.
C - I didn't say that, I didn't say that, so I would like to find out ........
O - In the complaint you're saying, "he put the uh, something fell down over Affiant's head like dust."
C - I said what?
O - "Affiant looked at Defendant, Defendant opened his hand and flicked something in the Affiant's face and said he thought he had a quarter. Defendant ran off laughing. Defendant returned approximately ten minutes later and had on plastice gloves. Defendant came close to Affiant (????) and then something fell over Affiant's head like dust. Defendant ran off again. Affiant then begins itching around neck, head and all over. Affiant went to the bathroom, took all of her clothes off, and kept scratching uncontrollably. Itching continued later that night, Affiant (????) to shower before heading over to Jewish Hospital for itching. Affiant received medicine and shots for itching."
"Affiant returned to work. Defendant came in contact with Affiant and put bugs in Affiant's hair. Affiant started itching and reaching in hair found eight red bugs in hair. Affiant went to pharmacy to get advice. Affiant got home and then called police."
"5/26/04 Affiant was in her area (??????), Defendant said to another, "Want me to do it?" (????)
"(????) front of Affiant's desk and moved the computer over and said, Did I get that on you? Defendant threw something down on Affiant's feet. Defendant started watching Affiant waiting for it to take effect. Affiant's feet started burning and itching, Affiant started scratching, her hands started turning red and swelling, along with feet swelling. (????) continued in the morning. Affiant could hardly walk due to swollen feet and called EMS."
"Affiant received two more shots at the hospital for itching, and prescription for itching medicine. Affiant is still taking medicine."
"Affiant shook out her clothes (?????), put them in container, Affiant also brushed (??????)"
O - What did the hospital say about all of this?
C - The hospital said I had come in contact with something
O - What was it?
C - Well, I had washed if off apparently, I told the police, and I told several people that I had some stuff I shook out of my clothes that could be it. As a matter of fact I told the police I had the clothes for a while, but they told me they did not need the clothes, the St. Matthews Police, but I do have the stuff that I shook out of my clothes. Like a dust, a black dust type stuff. That's what it is, that's what was thrown on me. The hospital says it's something that I came in contact with. I have no allergies or anything. My point is that's what I told them when I came in. Does that sould like harassment, no physical contact, it does not.
O - Actually, in reading it, a person can see it is Harassment withPhysical Contact
C - Well they have got harassment with no physical contact

C - When you throw stuff on somebody that's assault, no matter how you look at it
O - Well, well, it's a gray area (??????) you really don't know what it is
C - That's what I'm trying to say, I'm trying to say Mr. O'Malley that whoever wrote this out and .....
O - Ok (?????)
C - I have been told that it was Doc O'Connor, like I said, he is involved in the other case I have against Irv Maze in Cincinnati. They worte this out changing it to harassement, no physical contact.
C - What you just read to me does not sound like Harassement, No Physical contact, it sounds like Assault
O - If they wrote harassment on the charge, then that's what the original charge was, Ok. What you say in the complaint, is just what you say in the complaint, but the Prosecutor looks at it makes a judgment of what the charge will be and sends it on to a judge for a signature.
C - But I went to the hospital Mr. O'Malley, I was at the hospital
O - The hospital said they don't know what it is
C - The hospital said they don't know what was put on me. I had to end up getting shots, my skin was burning. How can that be changed to Harassment, No Physical Contact. The orignal charge should have been Assault.
O - Bring that up with the Prosecutor
C - Who is over the County Attorney's, the Prosecuting Attorney's Office?
O - Irv Maze is
C - Well, that's who I need to talk to because someone has changed this. Can you transfer me to him.
O - He's not in, He'll be back on Monday.
C - Well I'll get back with him then.

ANONYMOUS FEMALE/VICTIM'S TESTIMONY (I WILL NOT DISCLOSE HER NAME OR THE PEOPLE SHE IS SPEAKING ABOUT) SYMBOL - A - ANONYMOUS FEMALE/VICTIM ND - NOT DISCLOSE
A - As to the nature of my testimony against Bluegrass automotives, I am willing to testify that the company maintained an extremely hostile work environment, which I assume will be consistent with Ms. Marshall's testimony.
A - I can support my claim with several examples. to name a few:
A - Upon learning that I was involved in a same-sex relationship, one employee in particular (ND) made crude comments and asked personal questions on a regular basis, against my wishes ( I heard him inform some random customers tht I was gay by shouting it across the sales floor. On another occasion, he asked me what exactly my girlfriend and I do in bed together in front of another employee). there was some communication between myself and Jim Haynes after my resignation in which he actually put a great deal of the blame on me for being harassed at work, he said, because I was so open about my sexuality. In fact, I did not discuss my girlfriend with my coworkers beyond admitting that the woman who gave me a ride home from work regularly was my partner.
A - Additionally, (ND) also commented on my weight and my breast size rather frequently, in front of other employees. It was also (ND) who, despite my demands for him to stop and attempts to physically restrain him, shoved a partially eaten cookie into my face, wiping chocolate frosting all over me in the process.
A - On the day that I resigned, another employee, (ND) came up behind me at my desk and bit me on my neck as I talked to a customer on the phone. I decided that I could not handle working there under those conditions any longer, so I told the manager that I would have to leave, and that I would not be able to return as long as they still worked there. I did not push aggressively for any action to be taken, but I rejected any new job offers rom the company by Jim Haynes b/c the employees, who caused me the most grief were still there, not to mention the fact that it was Mr. Haynes that made such an effort to make me feel that the whole situation was my fault. So, asked why I did not pursue this as aggressively before, I would say that efforts by the company on the part of upper management to blame the victim (myself in this case), were a large contributing factor. I was left to wonder what I had done wrong to cause these men to feel that they could harass me and put their hands on me. In retrospect, I resent not only the behavior of the men who actively took part in making my life miserable as long as I worked there, but I also despise the members of management who support that sort of behavior.
A - In addition, (ND) did tell me on one occasion that he had lost a sexual harassment suit at another car lot before working at Bluegrass Auto. (ND, I think). Since Bluegrass Auto does a criminal background check, they may have known about it when he was hired if it was a criminal charge. It was, in any case, common knowledge at work.
A - This ends my written testimony for the moment. I will add more later. At least here will be an opportunity to read a bit about what sort of testimony to expect, and we will meet soon if you would like to discuss the case further.

I listened to the tape yesterday afternoon.
I was unable to confirm the conversation which you claim are on the tape. Nor was I able to confirm the conversations in thecourt reporters transcript. The tapes quality is so poor that we cannot discern any conversation.
To be sure of my conclusion, I gave the tape to another employeeunaware of the issues. I gave that employee the tape without the aid of your transcripts. That employee was unable to hear any thing from the tape.
Andy Vine listened to the tape and could not make out anything from the tape.
However, I am alarmed by the explosive, hateful, threatening statements you alledge are on the tape.The court reporter has heard something I could not hear or verify.Is it possible that I could listen to the original recording in a proper environment to fully investigate your claims.
I am also going to send the copy of the tape to a professional to see if anything intelligible can be heard from the copy you provided.
